A proxy marriage is a way to legally marry when at least one member of the couple is not present. It doesn't have to replace the wedding ceremony later.

This option can be particularly important for couples, as many benefits, such as housing benefit and health care, are only available to those who are officially married.

Being legally married also ensures that you can get help from others who are injured or killed in the process. These privileges are not given to girlfriends or fiancees, regardless of how long the couple has been together.

Proxy weddings are only available to couples in Montana, Colorado, Texas and California. In Colorado, one person must be out of state (or in jail). In California, only servicemen deployed to war (except Korea) can marry by proxy. And in Texas, someone has to be in-state and have an affidavit signed by the absent member.

Montana's Double Proxy Marriages Skyrocket After Pandemic

Montana makes it even easier if one of the participants is active duty or a resident. This enables a process known as "double proxy marriage". This system allows a couple to marry without either being present.

It is not always cheap to hire the services of a marriage officiant to solemnize or "sanctify" the marriage and make the whole thing official. In Montana, where the services hire two stands for a dual-licensed marriage, the fees range from $600 to $1,000.

If you want to get married by proxy in California, Texas, or Colorado, it's best to go to your local county clerk's office to get the exact information about proxy marriage fees and rules. This is because while a proxy marriage is legal in these states, each county may have its own specific processes and rules for obtaining one.

A proxy marriage is performed when the engaged couple cannot be physically present at their wedding. Each party completes the paperwork and submits it to our firm for approval by an attorney. The couple fell in love while serving in Afghanistan, but military chaplains don't perform weddings in war zones. Williams, a combat medic, and Fidler, a personal security officer, worried that they wouldn't be automatically notified if something happened to the other during a deployment because they had no legal ties.

Montana is the only state that allows authorized ceremonies as long as the person is a resident of the state or a member of the military. Stuehler takes advantage of an obscure law that dates back to the Montana gold rush of the 1800s. Miners who migrated to the territory for work needed the opportunity to marry their loved ones away from home.

More and more military couples took advantage of this loophole. Stuehler said he has conducted nearly 1,200 dual credential ceremonies in the past five years, 99 percent of which involve military personnel.
